Stop & Shop sues Teaneck – Here is the Complaint

On May 28, 2021 Howard D. Geneslaw, an attorney for Stop & Shop Supermarket LLC, sued both the Township of Teaneck and its Planning Board charging that the Township’s had, on April 13, 2021 adopted resolutions establishing an Area in Need of Redevelopment (AINR) that erroneously included the current Stop and Shop supermarket.
This suit, initiated by a Complaint in Lieu of Prerogative Writs sent to the Superior Court of NJ Law Division in Bergen County, alleges that the Council’s Resolutions Nos. 87-2021 and 88-2021 are “improper, unlawful, arbitrary, capricious, null and void and of no force or effect”.  The case, which Teaneck’s Township Counsel law firm has already spent well in excess of $21K defending, was continued to noon on June 9 in a Case Conference call between the litigants and Judge Christine Farrington that occurred on March 4,2022.
